Privacy Policy

This privacy policy applies to the "OffersMGR" service (hereinafter referred to as the "Service") operated by overflow Co. (hereinafter referred to as "the Company"), a service operated by overflow, Inc. (hereinafter referred to as "the Company"), a service operated by Overflow Inc.

Definition

  • Personal Information" has the meaning defined in Article 2.1 of the Personal Information Protection Law.
  • Anonymous Processed Information" has the meaning defined in Article 2, Paragraph 6 of the Personal Information Protection Law.
  • Personal Information with Special Considerations" has the meaning defined in Article 2, Paragraph 3 of the Personal Information Protection Law.

Purpose of Collection and Use of Personal Information

The Company will acquire and use personal information acquired through the Service for the following purposes
  • (1)To provide the Service and to inform you of the Service
  • (2)To provide information to customers, etc. regarding the Service and to respond to inquiries, etc. from customers, etc.
  • (3)To improve the Service and develop new services by the Company
  • (4)For marketing, research, and analysis for the purpose of improving and enhancing the quality of the Service
  • (5)To notify you of changes to the Terms of Service
  • (6)To ask questions, contact, or otherwise respond to violations of the Company's terms and conditions of this service
  • (7)To create statistical data processed into a format that does not fall under the category of personal information
  • (8)For other purposes incidental or related to the above purposes of use

Cookies and Access Logs

The Service collects cookies and access logs for the purpose of understanding and analyzing the use of the Service. You can set your web browser to allow or disallow the receipt of cookies. Please check the settings as necessary. Please note, however, that if you refuse to receive cookies, you may not be able to use some of the functions of the Service.

Acquisition of Personal Information and Changes in Purposes of Use

The Company may change the purpose of acquisition and use of personal information to the extent that it is reasonably deemed to be relevant to the purpose of acquisition and use of personal information.

Restrictions on Use of Personal Information

We will not handle personal information beyond the scope necessary to achieve the purpose of use without the consent of the individual, except as permitted by the Personal Information Protection Law or other laws and regulations. However, this does not apply in the following cases
  • (1)When required by law
  • (2)When it is necessary for the protection of the life, body, or property of an individual and it is difficult to obtain the consent of the individual.
  • (3)Cases in which the provision of personal information is particularly necessary for improving public health or promoting the sound growth of children, and in which it is difficult to obtain the consent of the person
  • (4)Cases in which the handling of personal information is necessary for cooperating with a national agency, a local government, or an individual or entity entrusted by either a national agency or local government to execute affairs prescribed by law, and in which obtaining the consent of the individual is likely to impede the execution of the affairs concerned.

Proper Acquisition of Personal Information

  • (1)We will acquire personal information in an appropriate manner and will not acquire personal information through deception or other wrongful means.
  • (2)We will not acquire personal information without obtaining the prior consent of the person concerned, except in the following cases
    • 1. Cases that fall under any of the above "Restrictions on the use of personal information".
    • 2. When the personal information requiring special consideration is publicly disclosed by the person in question, a national agency, a local government, a person listed in each item of Article 76, Paragraph 1 of the Personal Information Protection Law, or any other person specified by the Rules of the Personal Information Protection Commission.
    • 3. Cases in which the Required Personal Information is acquired by visually inspecting or photographing the individual and is deemed to be clear from the appearance of the individual
    • 4. Where the Company receives provision of the Personal Information with Special Considerations from a third party, and such provision by the third party falls under any of the items of Paragraph 1 of "Provision to a Third Party" below.
  • (3)When we receive personal information from a third party, we will confirm the following matters in accordance with the rules of the Personal Information Protection Committee. However, this excludes cases where the provision of personal information by the third party falls under any of the above "Restrictions on the use of personal information" or any of the items in Paragraph 1 of "Provision to a third party" below.
    • 1. the name and address of the third party, and in the case of a juridical person, the name of its representative (in the case of an unincorporated association with a representative or manager stipulated in its articles of incorporation, etc., the name of its representative or manager)
    • 2. History of acquisition of the relevant personal information by the third party

Security Management of Personal Information

We will exercise necessary and appropriate supervision over our employees to ensure the safe management of personal information against risks such as loss, destruction, falsification, and leakage of personal information. In addition, when we outsource all or part of the handling of personal information to a third party, we will provide necessary and appropriate supervision to ensure that the third party manages the personal information safely.

Provision of Personal Information to Third Parties

  • (1)We will not provide personal information to a third party without obtaining the prior consent of the individual, except in cases falling under any of the above-mentioned "Restrictions on Use of Personal Information. However, the following cases do not fall under the provision of personal information to third parties as stipulated above.
    • 1. Cases in which personal information is provided in conjunction with the outsourcing of all or part of the handling of personal information within the scope necessary for the achievement of the purpose of use
    • 2. Cases in which personal information is provided as a result of the succession of business due to merger or other reasons
    • 3. When personal information is jointly used in accordance with the provisions of the Personal Information Protection Law.
  • (2)Notwithstanding the preceding paragraph, except in cases falling under any of the above "Restrictions on the Use of Personal Information", we will not disclose personal information to any third party outside of Japan (with the meaning set forth in Article 28 of the Personal Information Protection Law. The same shall apply hereinafter in this paragraph). (excluding those who have established a system that conforms to the standards specified in the Rules of the Personal Information Protection Commission based on Article 28 of the Personal Information Protection Law). (2) When providing personal information to a third party located in a foreign country (excluding those who have established a system that conforms to the standards specified in the Personal Information Protection Commission Regulations based on Article 28 of the Personal Information Protection Law), the Company shall obtain the prior consent of the individual to the effect that the personal information may be provided to the third party.
  • (3)When we provide personal information to a third party, we will prepare and maintain records of the provision of personal information to the third party in accordance with Article 29 of the Act on the Protection of Personal Information.
  • (4)When we receive personal information from a third party, we will perform the necessary confirmation in accordance with Article 30 of the Personal Information Protection Law, and create and maintain a record of such confirmation.

Supplementation of Personal Information

We supplement, use, and manage your personal information with information obtained through your access history to the Service or through unrecognizable methods.

Disclosure of Personal Information

When we receive a request for disclosure of personal information or records of provision of personal information to third parties from an individual in accordance with the provisions of the Personal Information Protection Law, we will disclose such information to the individual without delay after confirming that the request is made by the individual himself/herself. However, this does not apply to cases in which we are not obligated to disclose the information under the Personal Information Protection Law or other laws and regulations.

Correction of Personal Information

If the Company is requested by an individual to correct, add, or delete his/her personal information (hereinafter referred to as "correction, etc.") based on the provisions of the Personal Information Protection Law because the personal information is not true, the Company will correct, add, or delete the information in accordance with the provisions of the Personal Information Protection Law. If the individual requests correction, addition, or deletion of his/her personal information (hereinafter referred to as "Correction, etc."), we will, after confirming that the request is made by the individual himself/herself, conduct the necessary investigation without delay to the extent necessary to achieve the purpose of use, and based on the results, correct, etc. the content of the personal information and notify the individual to that effect. However, this shall not apply to cases in which the Company is not obligated to make such corrections, etc. under the Personal Information Protection Law or other laws and regulations.

Suspension of Use of Personal Information

If we are requested by an individual to cease use or delete his/her personal information (hereinafter referred to as "cease of use, etc.") in accordance with the provisions of the Personal Information Protection Law on the grounds that such personal information has been handled beyond the scope of the purpose of use publicly announced in advance or has been obtained through deception or other wrongful means, or on the grounds that such personal information has been provided to a third party without the individual's consent, we will cease providing such information (hereinafter referred to as "cease of provision") in accordance with the provisions of the Personal Information Protection Law. (hereinafter referred to as "suspension of use, etc.") in accordance with the provisions of the Personal Information Protection Law, or suspension of provision of personal information (hereinafter referred to as "suspension of provision") in accordance with the provisions of the Personal Information Protection Law, on the grounds that the personal information has been provided to a third party without the consent of the person in question. In such cases, if it is found that there is a reason for the request, the Company will, without delay, upon confirming that the request was made by the person himself/herself, suspend the use or provision of the personal information and notify the person to that effect. However, this shall not apply in cases where we are not obligated to suspend the use or provision of personal information under the Personal Information Protection Law or other laws and regulations.

Handling of Anonymous Processed Information

We will follow the standards set forth in the Rules of the Personal Information Protection Commission with respect to the handling of Anonymous Processed Information.

Handling of Personal Information on Linked Websites

This service may contain links to external websites, but this privacy policy applies only to the handling of personal information obtained through this service. Please refer to the privacy policies of the linked websites for the handling of personal information on those websites.

Changes to the Privacy Policy

The Company will review its handling of personal information from time to time and strive for continuous improvement, and may change its privacy policy as necessary.
